Under the Residential Tenancies Act an occupying tenant is able to vacate the premises by issuing a minimum of 28 days notice to their managing agent on the basis that their lease has expired or is due to expire as at the time of vacating.

Should the tenant’s lease not have expired as at the time they wish to vacate, then in accordance with the Residential Tenancies Act and Clause 36 of the Lease Agreement the following expenses may be incurred;

- Payment of rent until a suitable tenant is found or until the completion of the Lease
- Advertising as agreed and incurred to secure new tenant.
- Pro-rata re-leasing fee
